- Emergency legislation signed by the President, yesterday, extends the Family and Medical Leave Act to small (under 50) employers. Employers will have to give paid leave to any employee who is out because they have the coronavirus or are caring for a family member with the virus. You can require medical certification and can require them to use their paid time off (vacation and sick days) prior to paying them for the time off. The leave can be up to 13 weeks.
