PLANNING & ZONING COMMISSION

The Planning and Zoning Commission of the City of Florissant met at the Florissant City Hall, on Monday, April 16, 2007 at 7:00 p.m., with Michael Meyer presiding.

On roll call the following members were present: Michael Meyer, Dick Weller, Ron Goodhart, Jack Gallagher, Jim Ross and Jane Boyle. Also present was Deborah Carter, Court Reporter and John Morgan, Building Commissioner.

A quorum being present the Chair declared the Planning and Zoning Commission was in session for the transaction of business.

Michael Meyer stated that the next order of business would be approval of the minutes for April 2, 2007. Michael Meyer made a motion to approve the minutes as written. Seconded by Jane Boyle. All parties concur. Motion carried.

Request Approval to Amend Ordinance

No. 6008 to Allow For An Expansion

to the Existing Space With a Full

Kitchen Facility. Zoned B-3.

The Chair stated Item Number One on the Agenda, Gettemeiers, located at 1740 Thunderbird. Request approval to amend Ordinance No. 6008 to allow for an expansion to the existing space with a full kitchen facility. Zoned B-3.

Jerry Gettemeier appeared before the Commission and stated that after ten years he now has an opportunity to expand his business by obtaining the space next door, which is currently being operated by State Beauty Supply. The expansion will include a full kitchen and restaurant.

Michael Meyer asked the Petitioner for his hours of operation? Mr. Gettemeier stated that although he will be seeking a Sunday license, his current hours are 11:00 a.m. to 1:30 a.m. Monday

through Saturday. The Petitioner is also exploring the possibility of opening at 7:00 a.m. on Saturday and Sunday. Mr. Meyer asked for the number of employees? Mr. Gettemeier stated that at full capacity there would be a maximum of five employees.

Mr. Meyer stated that based on the requirements for a sit down restaurant his estimation for required parking was 73 versus the 65 that are currently available. Mr. Morgan stated that the intent of the zoning code was for a single, stand-alone restaurant versus a strip center. Therefore, when a restaurant is located within a shopping center, parking is included in the overall parking for the center and not on an individual basis.

Mr. Gettemeier informed Mr. Meyer that there was also additional parking spaces located in the rear of the building. Mr. Meyer stated that the rear parking was not striped and that he did not see any designations for handicap parking.

Mr. Meyer informed the Petitioner that the trash dumpsters would have to be enclosed and that any new mechanical equipment would have to be screened. Mr. Gettemeier acknowledged the requirements and agreed to comply.

Jim Ross asked the Petitioner if the new exhaust fan ducts would be vented through the roof? Mr. Gettemeier stated that they would be.

Jack Gallagher asked the Petitioner if his employees would park in the rear of the building? Mr. Gettemeier stated that they could, although currently they park on the side of the building.

Commissioners Boyle and Goodhart both expressed a concern with the allotted parking.

Dick Weller asked the Petitioner if parking was permitted on either side of the street? Mr. Gettemeier stated that it was not. Mr. Weller questioned whether the rear of the building was large enough to accommodate employee parking and emergency vehicles? Mr. Gettemeier stated that there were fire lanes striped off in the rear of the building, which appeared to be sufficient. Mr. Weller asked if the parking lot in the rear of the building could be expanded? Mr. Gettemeier stated that the property was owned by MSD.

Jim Ross asked the Petitioner if there were any current parking problems? Mr. Gettemeier stated that parking has never been a problem and that currently when his facility is at capacity there is 42 remaining parking spaces.

Michael Meyer proposed a one year review by Council in hopes of addressing the Commission's parking concerns. Mr. Gettemeier asked for the consequences of such a review? Mr. Meyer stated that if there is no problems, Council could decide that a review was no longer necessary. However, if problems are discovered, then further action would need to be taken, which may require a reduction in table space within the restaurant.

Michael Meyer asked if there were any further questions or comments to the Petitioner? Being no further questions or comments, Michael Meyer made a motion to recommend approval to amend Ordinance No. 6008 to allow for an expansion to the existing space with a full kitchen facility for the property located at 1740 Thunderbird; Gettemeiers, with the following stipulations: that all new mechanical equipment be screened per the Code; that any new ventilation equipment be mounted through the roof; that all dumpsters be enclosed to comply with the City Ordinance and that a one year review of the parking accommodations currently available at this location be performed by City Council to determine if this expansion generates complications as a result of overflow parking. Seconded by Jim Ross. On roll call the Commission voted: Ross yes, Meyer yes, Gallagher yes, Goodhart yes, Weller yes and Boyle yes. Motion carried.

NOTE TO COUNCIL: It is the Petitioner's intent to apply for a Sunday Liquor License.

The hours of operation would be Monday through Friday 11:00 a.m. to 1:30 a.m., Saturday 7:00 a.m. to 1:30 a.m. and Sunday 7:00 a.m. to 12:00 a.m.

Michael Meyer asked if there were any further questions or comments? Being no further questions or comments, Jim Ross made a motion to adjourn the meeting. Seconded by Jack Gallagher. All parties concur and the meeting is adjourned at 7:30 p.m.
