COUNCIL MINUTES
July 12, 2010
The Florissant City Council met in regular session at the Florissant City Hall, 955 rue St. Francois on Monday, July 12, 2010 at 8:00 p.m. with Council President Keith English presiding. The Chair asked everyone to stand and join in the Pledge of Allegiance.
On Roll Call the following were present: Schmidt, Hernandez, Lee, Grib, Schneider, English, Schildroth, Podleski and McKay. Also present were City Attorney John Hessel and City Clerk Karen Goodwin. A quorum being present the Chair stated that the Council was in session for the transaction of business.
Councilman Lee moved to approve the Meeting Minutes of 6/28/2010, seconded by Grib. Motion carried.
The Chair stated that the next item on the agenda was Hearing from Citizens.
Rick Armstrong, 1580 Gallant Fox, thanked the Mayor for the trash and senior programs. Also, he expressed his concern about the residential property maintenance code in the City and suggested ideas to make improvements to the City.
Rosemary Davison, 555 Bluff Parks Drive, announced that Historic Florissant was encouraging residents to vacation in their own home town where “history comes alive.”
Elizabeth Bowling, 2915 Derhake, announced that the Neighborhood Watch Program had recently distributed information in Area 13 and encouraged those residents to attend the regularly scheduled meetings.
The Chair stated that the next item on the agenda was Communications of which there were none.
The Chair stated that the next item on the agenda was Public Hearings.
The City Clerk reported that Public Hearing #10-07-015 to be held this night on a request to authorize a Special Use Permit to Antoinette Fields d/b/a Tots-Lots Learning Center to allow for the operation of a child care business in a B-3 Zoning District for the property located at 2184 N. Waterford had been advertised in substantially the same form as appears in the foregoing publication and by posting the property. The Chair declared the Public Hearing to be open and invited those who wished to be heard to come forward. Antoinette Fields, petitioner, appeared before the Council and explained that her child care facility will hold up to 15 students, two to five years of age, will employee three staff members, will have a 760 square foot play area in the rear of the building and a 72” high vinyl fence compatible with the building. The food will be catered and the hours of operation will be Monday through Friday 6 a.m. until 6 p.m. According to the Fire Marshal, there was sufficient means of egress to access the building in case of a fire. Since the dumpster enclosure will be relocated, Councilman Podleski questioned whether it should be required to be constructed of brick. Councilwoman McKay informed the petitioner that variances were granted for some trash enclosures.The Chair asked if there were any citizens who would like to speak on said public hearing. Valerie Rhinesmith, 15509 Chaste, expressed her concern about the noise level in the strip mall and asked that sound walls be installed. Being no further speakers, Councilman Hernandez moved to close P.H. # 10-07-015, seconded by Schildroth. Motion carried.
The Chair stated that the next item on the agenda was Board Appointments.
Councilman Lee moved to reappointment James Ross, 15 Alandale, to the Planning and Zoning Commission as a member from Ward 2 for a term expiring on 6/12/2014, seconded by McKay. Motion carried.
Councilman Hernandez moved to reappointment Edna Ditto, 3580 Dwyer, to the Citizens Participation Committee as a member from Ward 9 for a term expiring on 5/27/2011, seconded by Lee. Motion carried.
Councilman Podleski moved to approve the request to repaint the masonry of Crown Car Wash located at 2040 N. Hwy. 67 a different color, seconded by Schneider. Councilman Podleski moved to suspend the rules to hear from the petitioner, seconded by English. Motion carried. Dale Collins appeared before the Council and explained that he had already started painting the building three weeks earlier, as a result of a City inspection, and was unaware that he needed Council approval. Councilman Lee informed Mr. Collins that according to City ordinance, brick can only be repainted due to maintenance issues. If there was to be a color change, it would be necessary for him to go before the Planning and Zoning Commission. Councilman Schmidt stated that this building was not brick, but over-sized concrete cinder blocks. On the motion for approval, motion carried. Whereupon the Chair declared the request approved.
Councilman Schneider introduced Bill No. 8634 An Ordinance to rezone from B-3 Extensive Commercial District to a B-5 Planned Commercial District the property located at 100 N. Hwy 67 to allow for the construction of a new bank with drive through facilities and signage and said Bill was read for the first time. Councilman Schneider moved that Bill No. 8634 be read for a second time, seconded by McKay. Motion carried and Bill No. 8634 was read for a second time. Councilman Schneider moved that Bill No. 8634 be read for a third time, seconded by Podleski. On roll call the Council voted: Schmidt yes, Hernandez yes, Lee yes, Grib yes, Schneider yes, English yes, Schildroth yes, Podleski yes and McKay yes. Having received the unanimous vote of all members present, Bill No. 8634 was read for the third and final time and placed upon its passage. Before the final vote all interested person were given an opportunity to be heard. On roll call the Council voted: Schmidt yes, Hernandez yes, Lee yes, Grib yes, Schneider yes, English yes, Schildroth yes, Podleski yes and McKay yes. The Chair declared Bill No. 8634 to have passed and said Bill became Ordinance No. 7714.
Councilman Hernandez introduced Bill No. 8635 An Ordinance granting a Special Use Permit to Antoinette Fields d/b/a Tot-Lots Learning Center, LLC, to allow for a child care center for the property located at 2184 N. Waterford and said Bill was read for the first time by title only.
Councilman English introduced Bill No. 8636 An Ordinance designating THF Florissant Development, LLC as the Preferred Developer with respect to the 3200-3400 North Highway 67 Redevelopment Area and authorizing the City to execute and deliver a Preliminary Funding Agreement and related contracts and engagement letters with City advisors in connection therewith and said Bill was read for the first time by title only.
Councilman Lee introduced Bill No. 8637 An Ordinance to amend Title II, Chapter 245.180 of the Florissant City Code, “Fee For Use,” by adding a new subsection 39 regarding the waiving of fees and said Bill was read for the first time. Councilwoman McKay moved that Bill No. 8637 be read for a second time, seconded by Podleski. Motion carried and Bill No. 8637 was read for a second time. Councilwoman McKay moved that Bill No. 8637 be read for a third time, seconded by Lee. On roll call the Council voted: Schmidt yes, Hernandez yes, Lee yes, Grib yes, Schneider no, English yes, Schildroth yes, Podleski yes and McKay yes. Having failed to receive the unanimous vote of all members present, Bill No. 8637 was not read for the third and final time.
The next item on the Agenda was Council Announcements.
Councilwoman McKay announced that the Relay for Life would be held August 6 & 7 at Hazelwood Central High School and invited everyone to come. Cancer survivors were invited to attend a survivor’s dinner which would start at 5:30.
Councilman Podleski announced that on August 15 at the Koch Family Aquatic Center, the Jaycees would be hosting the 8th annual Duck Race with proceeds to benefits Accessible Play.
Councilman Schildroth reminded everyone that the bridge on Graham Road was still closed and to follow the detour signs. He asked residents to not blow grass clippings into the streets because it caused stormwater back-ups. He thanked the administration and Park Board for the grant to remodel Bangert Pool. On July 16th from 8-9 pm there will be the annual “dive-in movie” at Bangert Pool.
Councilman Schneider thanked the Florissant Golf Course for hosting the annual Municipal League Golf Tournament.
Councilman Lee thanked the Mayor for “Splish Splash Summer Bash” at Koch Family Aquatic Center.
Councilman English announced that on September 4th at 1 p.m., Joe’s Pub will be hosting a benefit to collect care packages which go oversees to support our troops.
The next item on the Agenda was Message from the Mayor.
Mayor Lowery announced various programs for the Nature Lodge at Sunset Park. July 17 will be the 2nd Annual Suicide Prevention Walk & Barbeque as well as music/bands in St. Ferdinand Park.
Councilman Lee moved to call for a closed meeting to discuss personal matters pursuant to Section 610.021 of the Revised Statutes of Missouri, seconded by Grib. On Roll Call the Council voted: Schmidt yes, Hernandez yes, Lee yes, Grib yes, Schneider yes, English yes Schildroth yes, Podleski yes and McKay yes. The Council proceeded into closed session at 8:40 p.m.
